These Terms of Service ("Terms", "ToS") govern your access to and use of our website located at https://vektorkraft.com/ (the "Site") and your purchase of our digital design files, including but not limited to shadow box templates, light boxes, lanterns, pop-up cards, and other crafting files (collectively, the "Products").

1. Acceptance of Terms

By accessing, browsing, or purchasing from Vektor Kraft LLC, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. If you do not agree with any part of these Terms, you must not use our Site or purchase our Products. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

2. Account Creation and Security

To access certain features of our Site, such as retrieving past downloads or checking order history, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. Vektor Kraft LLC will not be liable for any loss or damage arising from your failure to protect your account information.

3. Digital Products and Delivery Disclaimer

Vektor Kraft LLC is exclusively a digital product store. There are absolutely no physical products shipped to you. All items available for purchase on our Site are downloadable digital files (typically provided in SVG, DXF, PDF, and PNG formats). Upon successful completion of your payment, you will receive an instant download link via email and on your order confirmation page. It is your responsibility to ensure you provide a correct email address and possess the necessary software, hardware, and knowledge to download, extract (unzip), and use these files.

4. Products and Licensing Terms

When you purchase a design from Vektor Kraft LLC, you are not buying the copyright to the design; rather, you are purchasing a license to use the design under specific conditions. Every file purchased from our store automatically includes a Commercial License for small business use. Please carefully review the permitted and prohibited uses below.

A. Permitted Uses (What You CAN Do)

  • Create Physical Products: You may use our digital files to cut, craft, and assemble physical end products (e.g., a physical paper shadow box, a cut and folded pop-up card, a wood or acrylic lantern).
  • Sell Physical Products: You may sell the physical items you have created using our designs at local craft fairs, markets, or online platforms (such as Etsy, Amazon Handmade, or your own website).
  • Unlimited Production: There is no limit on the number of physical items you can produce and sell using our purchased templates.
  • Modifications for Physical Use: You may resize, change colors, or make minor modifications to the files to suit your specific physical crafting needs.

B. Prohibited Uses (What You CANNOT Do)

  • No Digital Reselling: You are strictly prohibited from reselling, licensing, sub-licensing, or distributing the original digital files in any digital format whatsoever.
  • No File Sharing: You may not share, give away, or distribute our digital files to third parties, including in online crafting groups, forums, or social media platforms.
  • No Derivative Digital Works: You cannot modify our digital files and resell them as your own digital designs.
  • No Print-on-Demand (POD): You may not upload our designs to third-party Print-on-Demand websites (such as Redbubble, Zazzle, Printful, etc.) for commercial production.
  • No Claiming Ownership: You may not claim the digital designs, whether modified or unmodified, as your own intellectual property or original artwork.

5. Intellectual Property Rights

All content on this Site, including but not limited to digital designs, text, graphics, logos, images, audio clips, digital downloads, and software, is the exclusive property of Vektor Kraft LLC or its content suppliers and is protected by United States and international copyright laws. Purchasing a file does not transfer the copyright to you. Any unauthorized reproduction, distribution, or public display of our intellectual property is strictly prohibited and will result in immediate legal action.

6. General Prohibited Uses of the Site

In addition to the licensing restrictions, you agree not to use the Site:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • To upload or transmit viruses, malware, or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Site.
  • To spam, phish, pharm, pretext, spider, crawl, or scrape the Site's data.

7. Pricing and Payment

All prices for our digital products are listed in US Dollars (USD) and generally range from $3 to $10 per file. We reserve the right to change our prices at any time without prior notice. Payments are processed securely via third-party gateways (Shopify Payments and PayPal). By submitting your payment information, you represent and warrant that you have the legal right to use the payment method provided. Vektor Kraft LLC does not store your full credit card information.

8. Refund and Return Policy

Due to the irrevocable nature of digital goods, we generally do not offer refunds, returns, or exchanges once a file has been downloaded. Exceptions are made only in cases of corrupted files, missing formats, or duplicate accidental purchases. For complete details, please refer to our full Refund and Return Policy page. 9. Disclaimer of Warranties

Our Site and all digital products delivered to you are provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied. Vektor Kraft LLC does not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

Furthermore, we do not guarantee that our SVG, DXF, PDF, or PNG files will be compatible with every cutting machine, software version, or operating system. It is the buyer's sole responsibility to ensure software compatibility (e.g., Cricut Design Space, Silhouette Studio) prior to making a purchase.

10. Limitation of Liability

In no case shall Vektor Kraft LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service. In jurisdictions that do not allow the exclusion or the limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law, and in no event shall our liability exceed the total purchase price you paid to us for the specific product in question.

11. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services or Products shall be governed by and construed in accordance with the laws of the State of Kentucky, United States, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal or state courts located in the State of Kentucky. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
